1)
Congress’ sexual harassment system, decoded

ABOUT:
Recent revelations about sexual harassment and misconduct on the part of Congressmen have brought attention to the Office of Compliance, an obscure branch of Congress that acts as a kind of Human Resources for the institution. Over the past 20 years, 17 million dollars have been quietly paid out in settlements to complainants to the OOC, but not all of it was to sexual harassment settlements. In addition to sexual harassment claims against congressmen and aides, the OOC also handles complaints related to workplace safety and other issues. Because the OOC does not release details of the cases, and because it has many confidentiality measures in place, there’s no way to know what percentage of the 17 million went to settling sexual harassment claims.
The OOC is not the only way that congressional money is being used to settle sexual harassment claims, however. A complainant against Representative John Conyers was paid a settlement through Conyers’ own office, out of the office budget. His office created a fake position for the complainant and paid her for 3 months through payroll to the amount of $27,000. If this has been common practice, there’s no telling how much money has gone to settling these complaints.
Congresswoman Jackie Speier (D-CA) last week rallied against this state of affairs, saying that the OOC needs to have more transparency and that Congressmen should be legally liable for their behavior. She pointed out that the issue of sexual harassment is bipartisan, with accusations against congress members of both parties. In collaboration with Speier, Senator Kristen Gillibrand is sponsoring a bill that would require changes to the OOC. Meanwhile, both branches of government are instituting sexual harassment training , but some are concerned the current class, which is taken online, is not a strong enough measure to address the issue.

"The trappings of confidentiality, they permeate the process," said Alexis Ronickher, an attorney who has represented several clients pursuing harassment claims through the compliance office. "The law is written to create a system to disincentivize staffers from coming forward."

ADDITIONAL INFO:
The OOC, in addition to paying out settlements, also has procedures which keep victims quiet. As may be expected facing the OOC’s process, 80% of accusers choose not to follow up on their complaints.

OUR THOUGHTS (Laura H.):
If members of Congress are being shielded from the consequences of their own bad behavior using public money, this is a matter of public interest. Taxpayer money must cease to be used to provide cover for sexual harassers, whether through the OOC or through the Congressional offices. Most importantly, Congress should create a system where victims of misconduct are safe, and are able to get relief from their situations without being silenced.

“Siding with Trump, judge rules Mick Mulvaney to remain interim CFPB head”

ABOUT:
A battle for control of the Consumer Financial Protection Bureau took place this week, and exemplified the fight between Republicans and Democrats over how to regulate Wall Street following the 2007-2009 financial crisis that cost taxpayers $700 billion in bailouts. Last Friday, Richard Cordray stepped down as director of the Consumer Financial Protection Bureau. On his resignation, Cordray appointed an aide, Leandra English, to Acting Deputy Director of the CFPB. Upon hearing of Cordray’s resignation, President Trump appointed John Michael (Mick) Mulvaney to be Director of the CFPB. After a brief court battle, a judge ruled in Mulvaney’s favor, and he will be the acting director in the interim while President Trump decides on a permanent nominee for the role. By all accounts, Mulvaney is an arch fiscal conservative with an anti-regulation stance more extreme than most of his peers. Indeed, on his first day as Director, Mulvaney ordered a hiring freeze and ceased all cases in the pipeline.
“Referring to Trump's view of the watchdog's mission, Mulvaney said: "He wants me to get it back to the point where it can protect people without trampling on capitalism, without choking off the access to financial services that are so critical to so many folks."

The Consumer Financial Protection Bureau is a 1600-employee U.S. government agency that makes sure banks, lenders, and other financial companies treat consumers fairly. Following the 2007-2009 financial crisis, the CFPB was created under the Dodd-Frank Wall Street Reform and Consumer Protection Act (Dodd-Frank Act) and began operation in June of 2011. The CFPB acts as a watchdog for lending practices that leave people vulnerable to financial catastrophe, such as payday loans, bad student and mortgage loans, and exploitative credit card contracts. The organization also has a complaint line and provides sound financial advice to users of banks and loans. Since its inception, the CFPB has provided $11.9 billion dollars in relief from predatory practices to more than 29 million people, and handled more than 1.2 million complaints from individuals about predatory financial practices. https://www.consumerfinance.gov/
Interim director of the CFNB Mick Mulvaney is extremely fiscally conservative and has gained the nickname “Mick the Knife” for his eagerness to cut spending in government. In his previous role as Director of the Office of Management and Budget, Mulvaney has encouraged President Trump to slash the Medicaid and Medicare budgets, as well as Social Security disability benefits. In his role at the OMB, “[Mulvaney] has questioned whether government should fund Meals on Wheels or diabetes treatment for patients who “eat poorly,” called climate action “a waste of your money,” hinted that the Energy and Education departments might be unconstitutional, and suggested he would welcome another shutdown.” Mulvaney prioritizes the border wall and military spending. OUR THOUGHTS (Laura H.):
The CFPB acting as a watchdog and upholding the law against the banking industry is a necessary piece of government machinery. The detractors of the CFPB argue that the organization has too much power, but what about the banks? When an individual is defrauded through predatory practices, the CFPB might be their only recourse against a predatory lender. When the lending industry was given free reign, without regulation and a way to enforce it, it resulted in the 2007-2009 financial crisis, and the banks needed a 700 billion dollar bailout. Commercial banks have spent millions lobbying congress and millions in campaign contributions this year alone, the majority of them to republicans (https://www.opensecrets.org/industries/indus.php?ind=F03). They are likely happy with Mulvaney’s appointment; but we should not be. If Mulvaney follows the path of cutting and gutting the CFPB, there will be less protection for the individual against the powerful lending industry, and the economy will once again be at risk of catastrophe due to bad banking practices.

3)
Big Money Is Buying Up Puerto Rico’s Risky Real Estate

ABOUT:
Standard "buy low, sell high" market forces are at work in Puerto Rico after the devastation by two major hurricanes this past Summer/Fall. However, it appears not all (or even most) investors care about the local economy or its participants. And Puerto Rico is not the average "fixer upper", either.

EXCERPT:
The gambit could certainly work out -- many of the homes, after all, have spectacular views of the Caribbean that could be pitched to well-heeled Americans -- but long-time Puerto Rico investors see trouble ahead. Chief among their concerns: bidding wars are breaking out for the loans at the same time that their quality is deteriorating. It’s a tell-tale sign that the market is getting frothy and that turning a profit could prove tricky on an island where the government is mired in default, the economy has been contracting for a decade and foreclosure is a long and cumbersome process.

Blanco, who ran OCIF until December, when he became a real estate investor himself, said he remembers a dozen funds investing in Puerto Rico mortgage pools during his tenure.
“They did OK on some assets, and they didn’t do as well in others,” he said. “The foreclosure thing is one problem. Then there’s another problem, and it’s that Puerto Rico is still in financial straits. The economy here isn’t moving very well. So to dispose of assets is not easy.”

OUR THOUGHTS (Shalin M.):
With many investment firms inexperienced with real-estate and/or Puerto Rico in the hunt for "diamonds in the rough", the potential for haunting echoes of the housing crash to sound over an American island in the Caribbean is uncomfortably high. This is a situation that is made more difficult due to the island's financial situation. Thus, organization that know how to provide great care where the invest should be in order - however the incentive/disincentive structure does not appear to be sufficiently robust to encourage investors toward a path of the greatest wins for both profit and (local) people. And this is nothing to say of the legal battles after "bait & switch" tactics where property owners may become homeless. The work for new kinds of opportunities in Puerto Rico should proceed with additional care.

4)
Trump administration, in a gift to telecom firms, is pulling the plug on net neutrality

ABOUT:
Trump's pick for FCC chair, Ajit Pai, is leading the charge to rollback net neutrality rules enacted during the previous chair's term. The Internet Service Providers (ISPs) say this the rules are onerous and limit their ability to serve their shareholders with healthy profits.

EXCERPT:
At its heart, net neutrality is about guaranteeing a level playing field for all online services and content providers. It ensures that broadband providers such as phone and cable companies can't give preferential treatment to anyone — their own streaming-video service, say, over Netflix or Amazon Prime Video.

Now President Trump's appointee as FCC chairman, Ajit Pai, is proposing to gut those rules, which he said have "depressed investment in building and expanding broadband networks and deterred innovation."

Here's the catch: Along with giving phone companies the go-ahead to block calls, the FCC told them they can pass along to customers any costs incurred in stopping robocalls.
In other words, it's virtually guaranteed that if your phone company cracks down on robocalls, you'll see yet another fee on your bill. Or robocall filtering will be offered as an add-on service, like call waiting.
So the problem is being addressed.
But, like better broadband access, it'll cost you.

ADDITIONAL INFO:
Debates on the pros/cons of regulation of the internet have been going on for several years. This is primarily driven by nightmare scenarios of 1984's Big Brother using information of every man, woman, and child to enact an outsized influence on their lives through gentle or explicit coercion. But also, that internet sites will have limited access to viewers and vice-versa based on the whims of the ISPs.

OUR THOUGHTS (Shalin M.):
The idea of regulating the internet is a complicated endeavor as sometimes the "internet tollbooth operators" of which the ISPs would be are less dangerous than the "content captors" like Facebook, Apple, Amazon, and Alphabet (Google)! The idea of limiting visibility to some sites because of their content that may be unfavorable to the ISP (or its interests) shows an obvious and inherent conflict of interest. It is true there are issues to address on the "content captors" side as well, but rolling back net neutrality rules entirely would be dangerous and potentially a violation of the 1st Amendment. The decision to repeal the net neutrality rules should not even be held by the 5 members of the FCC rule committee on 14 Dec 2017.

Trump Made Millions of Dollars From Drug Money Laundering in Panama: Report

About:
Prior to running for president, Donald Trump profited through a drug-money laundering in Panama using a Trump affiliated property.

Excerpt:
The Sunlight Foundation has compiled a list of what it claims are Trump’s conflicts of interest: It numbers more than 600 for the president and 1,100 for the first family.
The report said the Panama project is a textbook case of money laundering.

“Investing in luxury properties is a tried and trusted way for criminals to move tainted cash into the legitimate financial system, where they can spend it freely,” the report noted. “Once scrubbed clean in this way, vast profits from criminal activities like trafficking people and drugs, organized crime, and terrorism can find their way into the U.S. and elsewhere.”

“In the case of the Trump Ocean Club, accepting easy – and possibly dirty – money early on would have been in Trump’s interest; a certain volume of pre-construction sales was necessary to secure financing for the project, which stood to net him $75.4 million by the end of 2010.”

Additional Info:
Trump is known to be strongly against personal use of any illegal narcotics. However, of course, he is also known to be one that cannot seem to resist acquiring more wealth. Around the time this is reported to have occurred, the Trump organization was having financial troubles.

Our Thoughts (Shalin M.):
Although it may be odd for Trump to knowingly support a narcotics operation, at the time it appears the "easy money" aspect of it was too tempting for him and his business partners. This is especially worrying now that he occupies the Oval Office and makes the reason for vigilance on all his moves and interests that much more important.

2.)
Feds: Philly officer sold drugs stolen by corrupt Baltimore police squad

About:
Federal agents have broken up a suspected illegal drug trade where members of the Baltimore police stole drugs from their city's drug dealers and sold them to Philadelphia Police force member.

Excerpt:
"Snell began his police career in Baltimore before arriving in Philadelphia in 2014. It was at the police academy in Maryland that he met Jemell Rayam, a fellow officer and his primary contact with the Baltimore Gun Trace Task Force.

The squad had been deployed to crack down on the proliferation of illegal guns in that city. But prosecutors now say that Rayam and several cohorts, including two commanding sergeants, used their positions to rob drug dealers and pocket hundreds of thousands of dollars uncovered while searching homes and cars of suspected criminals.

After Snell’s brother sold the drugs, the officer allegedly deposited $1,000 in proceeds in Rayam’s bank account, keeping $1,000 for himself. Several similar transactions followed over the next two months, the indictment alleges."

Additional Info:
This effort by federal agents appears to be associated with the request of former Baltimore Mayor Stephanie Rawlings-Blake request for federal support of the Baltimore Police Dept after the "uprising" events in April 2015.

Our Thoughts (Shalin M.):
This appears to be a good news / bad news story in that suspected Baltimore and Philadelphia police officers have a substantial amount of evidence against them and are now under arrest. However, it also gives the Baltimroe police department (another) black eye from the perspective of whom they are sworn to serve - the citizens of Baltimore city. Hopefully this will prevent others in the police force considering to embark on similar illegal activity.

3.)
House Democrats Help Republicans Pass $700B in Military Spending

About:
Despite prior pledges to oppose Trump's defense plans, many House Democrats voted to approve a military budget that was over the capped amount. And, again, makes plans to acquire more equipment than the Dept of Defense has requested.

"The total is nearly $100 billion more than President Trump requested earlier this year. It calls for 90 F-35 Joint Strike Fighters, 20 more than requested; 24 Navy F/A-18 Super Hornets, 10 more than requested; and 13 new Navy ships, five more than requested.

In a year of bitter partisan fights over healthcare, tax reform, and immigration, the House approved it with rare unity. The final vote was 356-70, including 127 out of the House's 194 Democratic members. The bill now goes to the Senate, where it's expected to be easily approved. An earlier Senate version was passed by a 89-8 margin. The nearly uniform Democratic support comes despite initial pledges to oppose Trump's proposed military spending increase, which was smaller than what they have now approved."

The reasons for House Democrats going back on their pledge to oppose Trump's military spending increase remains a mystery and warrants a closer look. However, considering that military contractors have strategically located offices and manufacturing in many House districts, it may have been a calculation for jobs and economic activity that the House Democrats relented to. This may also be why, again, the budget includes acquiring more equipment and systems than the US Dept of Defense has requested. This is an obvious symptom of the outsized influence of the "Military-Industrial Complex" that President Eisenhower warned about.

Trump turns to drug industry for his new health secretary

About:
After the ouster of Tom Price from the position of Health and Human Services Secretary, President Trump has tapped Alex Azar to lead. Azar served in senior roles under George W. Bush, but has worked for the pharmaceutical company Eli Lilly for the past 10 years. With his deep ties to the pharmaceutical industry and big business, many wonder if Azar will have conflicts of interest between lowering drug prices for Americans, and his loyalties to his former employer.

“Insurers and for-profit hospitals … reacted positively [to Azar’s nomination], while the Public Citizen advocacy group likened Azar’s nomination to a “coup d’etat” by drug companies…

If confirmed, Azar would join the club of Trump administration officials from big business. Ross was chairman of a private equity firm he founded and later sold. Treasury Secretary Steven Mnuchin was a former Goldman Sachs executive and hedge fund manager. Tillerson was CEO of ExxonMobil.”

Our Thoughts (Laura H.):
If the leadership of government and business is one in the same, who will be protecting the best interest of the American people when it comes in conflict with the best interest of a corporation’s bottom line? Eli Lilly’s raising of the price of insulin in order to improve profits is just one example of this conflict in action. While President Trump has rallied against the pharmaceutical industry at times, his appointment of Alex Azar suggests he is willing to join with the industry in order to pursue his own political goals, a theme that has arisen repeatedly in his appointments. While Azar’s background includes governmental leadership, in the current climate there is little beyond his own conscience to prevent Azar from continuing to work in the best interest of the already very powerful pharmaceutical companies. At the very least, his appointment brings about the potential for serious conflicts of interest, should he be confirmed.

Corruption trial of Senator Menendez ends in mistrial

About:
The corruption trial of New Jersey’s Democratic U.S. Senator Bob Menendez ended in a mistrial on Thursday. Menendez was accused of using his power as a U.S. Senator in various ways to help his personal friend and wealthy donor, ophthalmologist Salomon Melgen.

“Prosecutors accused Menendez of pressuring Medicare officials to change the agency’s billing practices after it concluded that Melgen overbilled it by millions of dollars….According to the government, Menendez also helped secure visas for the married Melgen’s foreign girlfriends and asked U.S. officials to resolve a port dispute in the Dominican Republic involving one of Melgen’s businesses…

In exchange, Melgen showered the senator with luxury vacations and hundreds of thousands of campaign dollars, prosecutors said.”

Additional Info:
A recent Supreme Court decision to vacate a bribery conviction (of former Virginia Governor Bob McDonnell) has narrowed the definition of corruption. The decision was relevant to the Menendez trial, and the trial judge even considered throwing out the case when the Supreme Court ruling was made. This more permissive ruling, paired with the information that the hung jury for the Menendez trial had deliberated to 10-2 in favor of acquittal, suggests the government will be hesitant to attempt prosecution corruption cases in the future.

Our Thoughts:
Robert Menendez is expected to run again for his seat. Of this recent trial, he has said ““To those who were digging my political grave so they could jump into my seat: I know who you are, and I won’t forget you.” Will our leaders really continue to be people who act badly, barely escape criminal conviction, and threaten political retaliation? If poor conduct on the part of Menendez is not currently illegal under the law, perhaps the law should be changed. Congress should develop legislation to prohibit officials from influence-peddling, and to do so will require a Congress willing to set rules for itself.

Becca F. came to become part of our RepMD in a rather unique way and has quickly become an important part of many of our strategies and campaigns. Her initial contact with our group was as a citizen journalist writing a piece on the multiple different organizations and strategies working to get the influence of big money out of politics. She decided to stay on as a volunteer and we couldn't be happier!

How did you find out about RepMD?
I was researching campaign finance reform organizations for an article.

What made you want to volunteer with RepMD?
The conversational strategy and engagement used by RepMD is going to further this issue more than anything else possibly could.

Why do you think getting big money out of politics is important?
The politicians are currently ignoring the people. I would like to change that.

What is your favorite provision of the AACA and why?
I like the classic crack-down on Super PACs. There is no reason that undisclosed money should be flowing to our politicians.

Besides fighting corruption, what else do you like to do?
I like to color, scrapbook and do artsy things.

What do you think the biggest problem our country is facing is?
A disenchantment with our own power to affect change.

Anything else you'd like us to know?
We need to force our elected officials to listen to the people that elected them again.

Private-Prison giant, resurgent in Trump era, gathers at president's resort

About:
Private for profit prison company is doing great . Also, they donated to Trump's campaign and just held a big event at his Florida hotel. After contributing 4x as much as in prior years to political causes (campaign funds and lobbyists), GEO Group, has now secured at least one contract for a private prison in TX, seen their stock triple, and is poised for many more new federal contracts.

The rise of influence from the private prison has been a controversial subject for many years with political influence being a chief concern.

Our Thoughts (Lisa M.):
Private prison companies spent lots of money on lobbyists, are now seeing financial benefit, and expect more business for housing immigration detainees and American citizens through increased arrests.

2) Monsanto says it knows more about weeds than weeds scientists.

About:
Monsanto pushes for use of an older pesticide, since it's genetically engineered corn and soybeans to tolerate it.

Excerpt:
"Monsanto's explanation for what happened this summer, and how to prevent it, seems to be carrying the day in Washington, D.C. Two weeks ago, the Environmental Protection Agency announced that it will allow continued use of dicamba next year. The EPA is imposing a few additional restrictions on who can spray it, and when. Those restrictions will have little effect, or none at all, on damage caused by volatilization.

Monsanto's influence on the federal agencies for agriculture and the environment is well known. Effectively, Monsanto owns the EPA and influences/steers it to its own benefit...and has been doing so for decades.

3) FCC ends decades-old rule designed to keep TV and radio under local control.

About:
Concerned voices have arisen on many sides since the FCC is changing a ruling that required local broadcasting groups to stay local to their broadcasting range.

Excerpt:
"Anyone who understands how these big media companies operate can see the danger," Christopher Ruddy, the chief executive of Newsmax, a conservative media company that asked the FCC to reject the Sinclair deal, wrote in a recent Post op-ed. "By owning local stations, the New York-based media networks could dictate local news coverage. With the planned elimination of the local studio rule, they will have a green light to do so."
Consumer group Free Press also are concerned with the change in the 80 year old rule, because media resources may now be centered in wealthy areas and diverted from smaller media markets.
This article from The Chicago Tribune also acknowledges that the Tribune itself is possibly going to be bought in a $3.9 billion deal by Sinclair, a right-wing broadcaster.

The FCC is in charge of regulating broadcasters and this is a notable change that the FCC claims "modernizes" the regulation.

Our thoughts (Laura H.):
It is unclear what changes may come about as a result of this change to an 80 year old rule, but one can imagine it will be significant. With television and radio media controlled by a fewer and fewer number of people, it seems there is a risk of one conglomerate having total control of a market, which is one thing if they are selling a product, but another if they are controlling the stream of information available to the public. It seems unlikely a national conglomerate will take the time to produce locally relevant material when they can provide coverage for a national audience more cost-effectively. One company could also have control of a whole territory, making their choice of message all the more powerful and influential.

4) Neighbor of Trump's interior secretary wins $300m contract to fix Puerto Rico power grid.

About:
After hurricanes Irma and Maria devastated Puerto Rico, the island has been mostly without consistent (or any) electricity. Contracts to coordinate/address the devastated electrical infrastructure went out to a single, small, politically connected company in Montana.

Excerpt:
"A small town electric company in Montana gained a $300 Million contract from the government of Puerto Rico to repair the island’s power grid. Rep. Raul Grijalva of Arizona, senior Democrat on the House natural resources committee, said Congress "needs to understand why the Whitefish contract was awarded and whether other, more cost-effective options were available."
The Interior Secretary, Ryan Zinke, has a son who worked at Whitefish, but contests that his son had no part in the decision-making that led to Whitefish getting the contract.

Whitefish reportedly got the deal because “Whitefish CEO Techmanski visited Puerto Rico in late summer while on vacation and established contact with PREPA and discussed potential future work, company spokesperson Chris Chiames said. When Maria hit Sept. 20, Whitefish was one of the companies that power authority officials were able to reach by satellite phone.”

Our thoughts (Laura H.):
It has been a tenet of our government, at least in theory, that those in leadership should seek to avoid even the appearance of having a conflict of interest between their personal business ties and their political decisions. Whitefish appears to be an insider deal that benefits a small group of people personally associated with Ryan Zincke, who is the Interior Secretary of the United States. It does not appear there is anything illegal about the deal. How should these types of conflicts be addressed in our government, and by whom? If those in leadership decide not to attempt to lead ethically, there seems to be no one to hold them accountable. It bears watching, what Representative Grijalva is able to learn about this issue and whether Congress will weigh in.

An article from The Nation drew on a report prepared by Veteran Intelligence Professionals for Sanity (VIPS). A recent report from VIPS, argues the theft of the DNC e-mails wasn’t a hack, but rather an inside leak.

Excerpt:
“Key among the findings of the independent forensic investigations is the conclusion that the DNC data was copied onto a storage device at a speed that far exceeds an Internet capability for a remote hack. Of equal importance, the forensics show that the copying was performed on the East coast of the U.S. [...]

This isn’t to say that Imran Awan or anyone from his crew had anything to do with the DNC leaks, but it should be noted that, despite what many in the media have pushed, their involvement can’t be ruled out either. Imran, after all, was Rep. Debbie Wasserman Schultz’s (D-FL) IT person at the time this data got out, which was also during the period when Rep. Wasserman Schultz was at the head of the DNC.

During the raucous 2016 presidential campaign news of leaks, emails, and related IT base things were being used as fodder to discredit various politicians or their aides.

Our thoughts (Shalin M.):
Information is power, the saying goes. And A LOT of information is contained in data servers of which are targets of hackers. This case bears watching as an "inside job" would reveal another area of conflict within the DNC: cyber. As has been seen in recent years, FEDERAL data has not been water-tight either calling into question the funded methods accross government and political parties used to contain and secure that data.

Don't forget to vote tomorrow!

local elections will be held in several Maryland cities

If you live in Frederick, Takoma Park, Greenbelt, Laurel, Bel Air, Annapolis or a number of other independent Maryland Jurisdictions, you have an election tomorrow! Don't forget to go vote and make your voice heard!!

Leading up to these elections, RepMD send out a survey to ask candidates how they feel about the issue of big money corrupting our political process. At the end of the survey, we gave candidates and opportunity to endorse us and our work and five did!

We sent our survey to over 60 candidates for office and only 6 replied. Sadly this was not unexpected and means a few things:
1) as an org, RepMD has more work to do to spread awareness about our group,
2) we have a lot of work to do to educate candidates (incumbents and other) about this important issue, and
3) we all need to work together to demand that elected officials represent the people, not their highest campaign donors.
